🧾 TERMS OF SERVICE

Welcome to Banana Pacific! The terms “we,” “us,” and “our” refer to Banana Pacific Trading Co. (“Banana Pacific”). We operate this online store and its related services, features, and content (collectively, the “Services”) to provide a curated shopping experience for our customers. Banana Pacific is powered by Shopify Inc., which hosts our platform and enables us to sell our products securely online.
By visiting or purchasing from Banana Pacific, you agree to the following Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, please refrain from accessing or using our Services.
1 – Eligibility and Account
To use the Services, you must be at least the age of majority in your province or territory of residence. You agree to provide accurate, current, and complete information when creating an account or making a purchase. You are responsible for maintaining the confidentiality of your login credentials and all activity that occurs under your account.
Banana Pacific reserves the right to refuse service, terminate accounts, or cancel orders in its discretion if misuse, fraud, or violation of these Terms is suspected.
2 – Product Information
We aim to display our products as accurately as possible. However, variations in colour or appearance may occur due to monitor differences. Product availability, pricing, and descriptions are subject to change at any time without notice. Banana Pacific reserves the right to discontinue any product at its discretion.
2A – Cosmetic Use Disclaimer
All Banana Pacific products are intended for external cosmetic use only. Do not ingest or apply to broken, irritated, or infected skin. Discontinue use if irritation occurs. Individual results may vary depending on skin type and sensitivity. Banana Pacific is not liable for misuse, allergic reactions, or failure to follow product instructions. Consult a physician before using new products if you have known sensitivities, medical conditions, or are pregnant or nursing.
3 – Orders and Acceptance
When you place an order, you are making an offer to purchase our products under these Terms. Orders are only accepted once payment is successfully processed. Banana Pacific reserves the right to cancel or refuse any order for any reason, including suspected fraud, payment issues, or product unavailability.
Once an order is placed, we may not be able to accommodate cancellation requests if it has entered fulfillment. If an order is cancelled by us, you will be notified and refunded in full.
Your purchases are subject to our Return & Refund Policy.
Nothing in these Terms limits your rights under applicable consumer-protection laws in British Columbia.
4 – Pricing, Taxes, and Billing
All prices are listed in Canadian Dollars (CAD) and exclude applicable taxes and shipping costs unless otherwise stated. Taxes (GST/HST/PST) are calculated at checkout based on your shipping address.
We make every effort to ensure pricing accuracy but reserve the right to correct errors. In the event of a pricing error, we may cancel or adjust your order after notifying you.
By completing a purchase, you agree to provide valid payment information and authorize us to charge the full order total. You represent that you are authorized to use the provided payment method.
5 – Shipping and Delivery
Orders are processed in the order received. Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Once a package is handed to the carrier, title and risk of loss transfer to the customer.
Tracking information is emailed once your order ships. If an item is lost in transit, please contact customerservice@bananapacific.ca, and we will assist in filing a carrier claim.
6 – Intellectual Property
All text, images, graphics, logos, trademarks, product packaging, and design elements on this website are the intellectual property of Banana Pacific or its licensors. You may not copy, reproduce, distribute, or use our content without express written permission. All rights not expressly granted are reserved.
7 – Optional Tools and Integrations
Shopify and its third-party apps may offer optional tools to enhance your shopping experience (for example, payment gateways, reviews, or shipping integrations). These are provided “as is” and “as available.” Banana Pacific is not responsible for their functionality, terms, or data practices. Use of such tools is at your own risk.

Our website may contain links to third-party sites for convenience. We are not responsible for the content, accuracy, or practices of any external websites. You should review third-party terms and privacy policies before using their services.
9 – Relationship with Shopify
Banana Pacific is powered by Shopify, but all purchases are made directly with Banana Pacific Trading Co. Shopify is not responsible for order fulfillment, refunds, or customer service. You expressly release Shopify from all claims arising from transactions with Banana Pacific.
10 – Privacy
Your personal information is collected and processed in accordance with our Privacy Policy. Banana Pacific complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.
11 – Feedback and Reviews
Any ideas, comments, reviews, or suggestions (“Feedback”) submitted to Banana Pacific may be used for marketing or improvement purposes. By submitting Feedback, you grant Banana Pacific a non-exclusive, royalty-free, perpetual, worldwide license to use, modify, and publish your content. You confirm that your Feedback does not violate any third-party rights.
12 – Errors, Inaccuracies, and Omissions
Occasionally there may be errors in pricing, product descriptions, or availability. We reserve the right to correct or update information at any time, including after an order has been submitted.

You agree not to misuse our Services, including engaging in fraud, harassment, data scraping, distribution of malware, or violating any law. We reserve the right to suspend or terminate accounts for such activities.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
You agree to the exclusive jurisdiction of the courts of British Columbia, located in Nanaimo, for any dispute.
20 – Changes to Terms
We may revise these Terms from time to time. Updated versions take effect upon posting. Continued use of our Services constitutes acceptance of the revised Terms.
